1. Prerequisites
Processing Timeframes:
For this type of Application, the Authority is allocating a maximum 90 day timeframe to inform the applicant with a decision.
This timeframe is initiated once all the needed documentation is received and the application is fully vetted and validated. The Application processing timeframe shall be suspended if additional information or documentation is requested from the applicant or from other third parties (including the Joint Office). The 90 day timeframe shall then resume when the applicant or the third party submits the requested information or documentation.
If the applicant fails to submit the pending documentation or carry out the requested rectifications within the stipulated timeframes set by the Authority, the application shall be closed and archived.
In order to complete this application you will require the following documents:
- Declaration form that the entire content of the application is true and that no information or other relevant facts have been omitted, which had they been known to the Authority would have caused the denial or refusal of said application. No applicant may justify such omissions on the basis that the omitted information or facts were known to the Authority. See LA Declaration of the application.
- A site plan authenticated by an Architect at a 1:2500 scale indicating the exact property location on the 2018 Planning Authority basemap, clearly showing the extent and position of the property as well as the distance from the nearest corner.
- A site plan authenticated by an Architect at a 1:2500 scale indicating the exact property location on the 2018 Planning Authority basemap, showing the applicant’s property, the government property and the proposed establishment of servitudes or real rights over government property.
- Recent photos of the site or property (in .jpeg format) indicating date when these were taken.
Note: Photos are to include at least 2 different streetscape views and another fronting the site or property. - Copy of contract/s showing title of applicant's property.
- A Google Maps satellite image indicating the extent and position of the property.
- Any other document you may think is relevant to the application
- Note: Plans and drawings are to be submitted in both AutoCAD 2010 DWG and .pdf format.

Servitudes and other similar rights may be created on government land whenever such rights are required for the proper use of any other land by any other person, and it would not be the case that such right is given on encroachment terms. In any other case such rights may and shall be given on encroachment terms.
This application together with all decisions including documents pertinent to this application, including the application report containing the CEO’s recommendation, the eventual Authority’s decision together with the relative documents including the reasons for the grant of such permissions or refusal shall be made available for public inspection.
In terms of Article 57 of Chapter 563 of the Laws of Malta, regarding the Lands Authority Act (2017), the public is notified that any person aggrieved by any decision of the Authority, with the exception of decisions related to cases which fall under the competence of the Land Arbitration Board, may lodge an objection with the Administrative Review Tribunal, as established by article 5 of the Administrative Justice Act, within twenty days, from the receipt of the Authority’s decision.
